摘 要
本篇对离婚损害赔偿制度的含义、法律特征、性质、构成要件、赔偿情形及其他司法解释有关规定进行了重点论述，特别是对离婚损害赔偿制度的主体责任范围、过错方和无过错方的界定、举证责任、诉讼时效及离婚损害赔偿是适用于诉讼离婚还是登记离婚诉讼问题提出了自己的看法和见解，事实上精神抚慰金计算。对全面理解离婚损害赔偿制度，更好地保障婚姻当事人的合法权益，维护正常的婚姻关系，实现法律的公平与公正具有极其重要的意义。
