[转载]医疗事故赔偿的五个步骤

无论多少复杂的医疗纠纷，获得相应的医疗事故赔偿是患方的最终目的。也就是说，赔偿是整个医疗事故处理的核心问题。如果这个核心问题得不到客观、公正处理，医患双方因医疗事故引发的纠纷就会没完没了地闹下去。新的《医疗事故处理条例》(以下简称《条例》)使这一问题得以定性和初步量化。

笔者认为，医疗事故赔偿确认要经过五个步骤:

第一步，申请医疗事故技术鉴定。医疗事故可通过三条途径解决:双方自行协商、向卫生行政部门提出处理申请或向人民法院提起诉讼。解决的关键在于医疗事故的技术鉴定，医疗事件先由医院所在辖区的区县医学会进行首次鉴定;当事人对首次鉴定结论不服的，可提出再次鉴定的申请，市医学会负责组织鉴定;如果对再次鉴定结论仍不服，可向法院提起诉讼，由法院最终判决。北京首次(区级)鉴定费是3000元，再次(市级)鉴定费是3500元，属医疗事故鉴定费由医院承担，非医疗事故鉴定费由患方承担。

第二步，由医学会给出医疗事故鉴定报告。报告通常包括三个层次，一、是否属医疗事故。二、属几级医疗事故(一级医疗事故:造成患者死亡、重度残疾的;二级医疗事故:造成患者中度残疾、器官组织损伤导致严重功能障碍的;三级医疗事故:造成患者轻度残疾、器官组织损伤导致一般功能障碍的;四级医疗事故:造成患者明显人身损害的其他后果的)。三、医疗人员负有哪种责任(完全责任，医疗机构承担100%的赔偿责任;主要责任承担70%的赔偿责任;次要责任，医疗。承担30%的赔偿责任;轻微责任，承担10%的赔偿责任)。

第三步，根据《条例》规定的11项标准计算的医疗事故赔偿基数。

(一)医疗费:按照医疗事故对患者造成的人身损害进行治疗所发生的医疗费用计算，凭据支付，但不包括原发病医疗费用。结案后确实需要继续治疗的，按照基本医疗费用支付。原则上按照本市基本医疗保险医疗服务设施范围、用药范围、诊疗项目等确定，实行一次性结算。

(二)误工费:患者有固定收入的，按照本人因误工减少的固定收入计算，对收入高于医疗事故发生地上一年度职工年平均工资3倍以上的，按照3倍计算;无固定收入的，按照医疗事故发生地上一年度职工年平均工资计算。2005年，北京地区职工年平均工资为元。

(三)住院伙食补助费:按照医疗事故发生地国家机关一般工作人员的出差伙食补助标准计算，20元一天。
