摘要：善意取得制度作为民法物权中的一项重要制度，http://www.hnfzb.gov.cn/a/falvzhuanti/zhapianzuidegouchengyaojian/2012/0130/430161.html。它对于促进和保护交易安全、维护和稳定社会经济秩序有着非常积极的作用。我国现行民事立法尚未在整体上实现善意取得制度的立法化，因此关于这一制度的理论研讨就具有很重要的现实意义。目前我国虽没有在正式的法典中对它予以承认, 但在一些相关法律文件中间接地对善意取得制度作了说明。完善善意取得制度有利于更有效地调节民事法律关系和促进经济的发展。应大胆借鉴和吸收国外先进的立法经验, 力争与国际司法接轨。如何正确地理解和运用这一制度有很重要的现实意义。
