AGREEMENT FOR PROVIDING TEMPORARY WORKERS 临时工派遣协议 Between PartyA:TheFourPointsBySherastonShanghai,Daning(hereinafterdesignatedastheHOTEL) And PartyB:ForestreetservicecompanyLtd.(hereinafterdesignatedastheFORESTREETTEMP) 甲方:(以下简称:酒店)
b. FORESTREETTEMPlikewiseguaranteesthattheworkersemployedbyFORESTREETTEMPandassignedtotheHOTELshallcarryouttheirobligationsunderthisagreementwhiletheabovesaidemployeesshallnotbeconsideredemployeesbytheHOTEL.WhethertheyareassignedinthepremisesoftheHOTEL,ortheassignmentisinterrupted,theemploymentrelationshipbetweenthemandFORESTREETTEMPshallbebynomeansaffected. FORESTREETTEMP同时保证使用并指派给酒店的临时工仅是根据协议完成酒店工作,并不属于酒店的雇员,他们被分配到酒店工作或中止其工作,并不影响他们与FORESTREETTEMP的雇佣关系。 c. NothinghereincontainedshallbeconsideredthatbetweentheHOTEL,FORESTREETTEMPanditscontractualworker,arelationshipofemploymenthasbeenestablished.Inthiscase,itisFORESTREETTEMPthatwilltakeallliabilitiesonhisowninaccordancewithrelevantlaws,rulesorregulationsonlabor.IfthereshouldbeanyincidentalinjuryordeathtothetemporaryworkerworkingfortheHOTEL,theFORESTREETTEMPwouldmakethecompensationfortheincidentalinjuryordeathaccordingtothenationalregulationsoninsuranceforworkincidentwhiletheHOTELwillnottakeanyliabilities.However,theHOTELhastheobligationtoassisttheFORESTREETTEMPindealingwiththerelevantmattersandprovidingnecessarydocumentswhichareneededfortheFORESTREETTEMPtomakeclaimsforworkinjuryinsurance. 此合同不被视为酒店、FORESTREETTEMP及临时工之间建立了雇佣关系。因此, FORESTREETTEMP应依据法律法规和劳动法,独立承担责任。而酒店对以下情况不负任何责任:个人受伤的索赔、和其它劳动福利、其它伤害的索赔包括因FORESTREETTEMP的临时工或第三方引起的事件,不管这类伤亡是否发生在临时工履行合同规定的工作职责时。以上情况FORESTREETTEMP需保证如实支付赔偿。 修改为:对于乙方派遣的临时工,在甲方工作期间发生意外人身伤害的,赔偿及善后工作的处理,按照国家有关工伤保险的规定执行,甲方不承担赔偿责任。但甲方有义务协助乙方处理有关事宜,并提供乙方办理工伤保险赔偿事宜所必须的书面材料,。 TheHOTELshallprovideasafeandsanitaryworkingenvironmentforthetemporaryworkersanditshallinformhisworkersofthetake-outservicebeforehand.(酒店应提供安全健康的工作环境,对于外卖活动的安排应事前通知) (责任编辑:admin) |
